Prosecutor Gets Berated By Judge In Car Theft Case

THE CHIEF FEDERAL JUDGE in Brooklyn delivered an unusually harsh rebuke to federal prosecutors - allowing the defendant to walk away with no jail time while demanding, "Who made the decision to indict this case?"
Judge Edward Korman ridiculed the U.S. attorney's office yesterday for going after an ex-Secret Service employee for allegedly stealing five government autos damaged at Ground Zero and bound for the landfill.
"Is that a crime?" Korman asked the prosecutor. "To say that someone stole something that the government is sending to the dump, is a real stretch."
The defendant, William Bennette, a retired NYPD sergeant hired by the Secret Service in 1999, pleaded guilty earlier this year to filching the vehicles and fabricating documents in order to obtain new titles of ownership.
